This document must be signed before participating in any class, trial, or activity at Sidekick Martial Arts & Fitness, operated by Sidekick Martial Arts, LLC ("the School"), located at 155 Route 17S, Hasbrouck Heights, NJ 07604. If the Participant is under 18, this document must be signed by a parent or legal guardian ("Guardian"), who agrees to all terms on their own behalf and on behalf of the Participant to the fullest extent permitted by New Jersey law.

1. Assumption of Risk

Martial arts is a physical contact activity. Training at the School includes, without limitation: striking, kicking, sparring, grappling, throws, takedowns, falls, board breaking, weapons training (including Kali stick work), kettlebell and strength conditioning, and partner drills. I understand that participation carries inherent risks that cannot be eliminated even with proper instruction and supervision, including but not limited to: bruises, sprains, strains, broken bones, concussion, joint injuries, heart-related events, paralysis, and death.

I voluntarily choose to participate (or to allow the Participant to participate) with full knowledge of these risks, and I assume all risks of injury, illness, or damage arising out of participation, whether occurring during class, open training, testing, events, or on the School's premises.

2. Release and Waiver of Liability

To the fullest extent permitted by law, I release, waive, and discharge Sidekick Martial Arts, LLC, its owners, instructors, employees, volunteers, and agents (the "Released Parties") from any and all claims, demands, or causes of action arising out of or related to any loss, damage, or injury - including death - sustained in connection with participation in School activities or presence on School premises, including claims arising from the ordinary negligence of the Released Parties.

If the Participant is a minor, I additionally release and waive, on my own behalf as Guardian, any claims I personally hold arising from the Participant's injury, including claims for medical expenses, loss of services, and emotional distress.

I understand that this release does not apply to gross negligence, recklessness, or intentional misconduct.

3. Indemnification

I agree to indemnify and hold harmless the Released Parties from any claims brought by me, the Participant, or any third party on the Participant's behalf, including reasonable attorneys' fees, to the extent such claims are released or waived under this agreement.

4. Agreement to Arbitrate

I agree that any dispute, claim, or controversy arising out of or relating to participation in School activities, including any claim of injury to me or the Participant, shall be resolved exclusively by binding arbitration in Bergen County, New Jersey, administered under the rules of the American Arbitration Association, rather than in court. I understand that by agreeing to arbitration, I am waiving the right to a trial by jury. This arbitration agreement is signed on my own behalf and, if the Participant is a minor, on the Participant's behalf.

5. Medical Authorization

I represent that the Participant is physically able to participate and has no medical condition that would make participation unsafe, except as disclosed to the School in writing. In the event of injury or medical emergency, I authorize the School to obtain emergency medical treatment for the Participant, and I accept financial responsibility for any such treatment.

6. Media Release

I grant the School permission to photograph or record the Participant during classes and events, and to use such images or video for the School's promotional purposes (website, social media, printed materials) without compensation. I may revoke this permission at any time by written notice to the School; revocation applies to future use only.

7. Rules and Conduct

I agree that the Participant will follow all School rules, instructor directions, and safety guidelines. The School may suspend or remove any participant whose conduct creates a safety risk.

8. General Terms

This agreement is governed by the laws of the State of New Jersey. If any provision is found unenforceable, the remaining provisions remain in full effect. This agreement remains in effect for the duration of the Participant's involvement with the School, including trial classes, and any return to training after a break in enrollment.
